Computech Systems Inc. (“Computech,” “we,” “us,” or “our”) respects the privacy of our customers and users. This Privacy Policy explains how Computech collects, uses, stores, protects, accesses, and deletes information in connection with the RaceBase racing software, RaceBase mobile application, RaceBase accounts, associated cloud services, Computech websites, and other RaceBase-related services (collectively, the “RaceBase Services”).

By creating a RaceBase account, entering information into RaceBase, using the RaceBase mobile application, synchronizing or uploading information, or otherwise using the RaceBase Services, you acknowledge that information you provide may be transmitted to, stored by, processed by, and accessible to Computech as described in this Privacy Policy.

1. INFORMATION YOU PROVIDE TO RACEBASE

RaceBase is designed to function as a racing logbook, database, analysis, weather, and performance-prediction system. Much of the information stored in RaceBase is information that you voluntarily enter, upload, create, import, or otherwise provide.

Depending on the features you use, this information may include:

  • Name;
  • Email address;
  • Telephone number;
  • Account username or other account identifiers;
  • Account and subscription information;
  • Vehicle information;
  • Driver information;
  • Racing history;
  • Race results;
  • Run and time-slip information;
  • Reaction times;
  • Elapsed times;
  • Dial-ins;
  • Predictions;
  • Track information;
  • Racing classes and categories;
  • Weather information;
  • Performance information;
  • Vehicle setup and configuration information;
  • Notes and comments;
  • Custom RaceBase fields and variables;
  • Data imported from compatible Computech products or services;
  • Data uploaded from RaceAir, RaceAir Cloud, DataMaxx, or other compatible products;
  • Photographs, attachments, or files where supported;
  • Location information when you voluntarily provide it or enable a feature requiring location;
  • Other information you choose to enter into RaceBase.

You control the information you choose to enter into RaceBase.

You should not enter personal information into RaceBase that you do not want stored or processed as part of your RaceBase account.

2. COMPUTECH’S ACCESS TO YOUR INFORMATION

When information is stored in or synchronized with RaceBase’s servers or cloud-based services, Computech may have technical and administrative access to that information.

This access may be necessary to:

  • Operate RaceBase;
  • Synchronize information between devices;
  • Maintain user accounts;
  • Provide customer and technical support;
  • Diagnose software problems;
  • Maintain and improve RaceBase;
  • Recover from technical failures before an account has been deleted;
  • Protect the security and integrity of RaceBase;
  • Investigate unauthorized access, fraud, abuse, or violations of applicable agreements;
  • Comply with applicable law; and
  • Provide features requested by the user.

Computech employees and authorized personnel are expected to access user information only when reasonably necessary for legitimate business, technical, security, support, or legal purposes.

The fact that Computech may have access to information in your RaceBase account does not mean that Computech owns your racing data or has the right to sell or commercially distribute your personal information.

3. WE DO NOT SELL OR SHARE YOUR PERSONAL DATA

Computech does not sell your personal information.

Computech does not rent your personal information.

Computech does not provide your personal RaceBase data to other racers, racing organizations, advertisers, data brokers, competitors, or other unrelated third parties for their independent marketing or commercial use.

Information that you place into RaceBase is intended to remain associated with your account and to be used to provide the RaceBase Services to you.

Computech will not disclose your personal RaceBase information to unrelated third parties except:

  1. When you specifically direct or authorize us to do so;
  2. When disclosure is reasonably necessary to a service provider acting on Computech’s behalf to operate the RaceBase Services, subject to appropriate confidentiality and data-protection obligations;
  3. When reasonably necessary to protect the security, rights, property, or safety of Computech, RaceBase, our customers, or others;
  4. To investigate fraud, unauthorized access, abuse, or unlawful activity; or
  5. When Computech is legally required to disclose information pursuant to applicable law, a valid subpoena, court order, warrant, or other legally enforceable governmental request.

Computech does not use the personal information contained within your RaceBase account for third-party targeted advertising.

4. USER-ENTERED RACING DATA

RaceBase allows users to create a detailed racing database.

The user is responsible for determining what information is entered into that database and for ensuring that the user has the legal right to enter, upload, or store that information.

Your RaceBase database may contain information that is commercially valuable, confidential, proprietary, or personally important to you.

Computech recognizes the importance of this information and will not knowingly disclose a user’s private RaceBase database to another RaceBase user or unrelated third party except as specifically described in this Privacy Policy.

5. INFORMATION COLLECTED AUTOMATICALLY

When you use the RaceBase Services, certain technical information may be collected automatically, including:

  • Device type;
  • Operating system;
  • Application version;
  • IP address;
  • Device or application identifiers;
  • Login activity;
  • Date and time of access;
  • Error and crash information;
  • Diagnostic information;
  • Synchronization activity;
  • Feature usage;
  • Security-related information; and
  • Other technical information reasonably necessary to operate, secure, troubleshoot, and improve the RaceBase Services.

Computech limits the collection and use of this information to legitimate operational, security, analytical, support, and product-improvement purposes.

6. LOCATION INFORMATION

Certain RaceBase features may use location information, including features involving racetracks, weather conditions, RaceAir Cloud, TrackSide weather information, or other location-dependent services.

Where required by the operating system, RaceBase will request permission before accessing device location information.

You may disable location access through your device settings. Certain RaceBase features may not function properly if location services are disabled.

Computech does not sell location information.

7. HOW WE USE INFORMATION

Computech may use information collected through RaceBase to:

  • Create and maintain your account;
  • Authenticate users;
  • Operate RaceBase;
  • Store and synchronize RaceBase information;
  • Provide racing logbook functionality;
  • Provide calculations and predictions;
  • Provide weather-related functionality;
  • Integrate compatible Computech products and services;
  • Provide customer support;
  • Respond to questions and technical-support requests;
  • Diagnose software and synchronization problems;
  • Maintain the security of the RaceBase Services;
  • Prevent unauthorized access and fraud;
  • Develop, test, maintain, and improve RaceBase;
  • Communicate important account, software, security, or service information; and
  • Comply with applicable legal requirements.

Computech will not use personal information for purposes that are materially incompatible with the purposes described in this Privacy Policy without providing appropriate notice or obtaining consent when required by law.

8. OWNERSHIP OF USER DATA

As between you and Computech, you retain your rights in the racing information, vehicle information, run information, notes, and other original data that you enter into RaceBase.

Your use of RaceBase gives Computech permission to host, store, process, transmit, copy, and otherwise technically handle that information only as reasonably necessary to operate and provide the RaceBase Services and as otherwise described in this Privacy Policy.

Use of Computech software, formulas, algorithms, calculations, prediction systems, databases, interfaces, trademarks, and other intellectual property remains subject to Computech’s applicable license agreements, Terms and Conditions, and intellectual-property rights.

9. DATA SECURITY

Computech uses reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, acquisition, disclosure, alteration, or destruction.

These measures may include access controls, authentication systems, server security, network protections, monitoring, and other safeguards appropriate to the nature of the information being maintained.

No computer system, mobile application, Internet transmission, or electronic storage system can be guaranteed to be completely secure. Accordingly, Computech cannot guarantee that unauthorized third parties will never defeat security measures.

Users are responsible for protecting their RaceBase passwords and account credentials and should not provide those credentials to unauthorized persons.

10. DATA BREACHES

If Computech discovers a security breach involving personal information, Computech will investigate and respond to the incident in accordance with applicable law, including applicable requirements of the Maryland Personal Information Protection Act.

Where notification is legally required, Computech will provide notification within the time and in the manner required by applicable law.

11. ACCOUNT DELETION AND PERMANENT DELETION OF DATA

Deleting a RaceBase account is permanent.

When you request and complete deletion of your RaceBase account, the RaceBase information associated with that account that Computech is not legally required to retain will be permanently deleted from Computech’s systems in accordance with our deletion procedures.

This includes user-entered RaceBase information associated with the deleted account.

ACCOUNT DELETION CANNOT BE UNDONE.

Once the deletion process has been completed:

Your account cannot be restored.

Your RaceBase database cannot be restored.

Your racing history cannot be restored.

Your user-entered information cannot be recovered by Computech.

Computech cannot recover deleted account data for you, even if the deletion was accidental.

Before deleting an account, users are responsible for exporting, downloading, copying, printing, or otherwise preserving any information they wish to retain, where an export feature is available.

Computech strongly recommends that users maintain their own copies or backups of important racing information before requesting account deletion.

Deletion of an account does not require Computech to delete information that applicable law requires Computech to retain, nor does it require deletion of minimal records that may legally be retained solely to document or honor the deletion request. Any such information will not be used to recreate or restore the deleted RaceBase account.

12. REMOVING THE MOBILE APP DOES NOT DELETE YOUR ACCOUNT

Deleting or uninstalling the RaceBase mobile application from a phone or tablet does not automatically delete your RaceBase account or the information stored in the account.

If you want your account and associated server-side information permanently deleted, you must use the account-deletion function provided by RaceBase or submit an account-deletion request to Computech.

This distinction is important. Removing an application from a device and deleting a RaceBase account are separate actions.

13. DATA RETENTION

Computech retains personal information for as long as reasonably necessary to:

  • Maintain an active RaceBase account;
  • Provide the RaceBase Services;
  • Fulfill the purposes described in this Privacy Policy;
  • Maintain security and prevent fraud;
  • Resolve disputes;
  • Satisfy legitimate accounting or business requirements; and
  • Meet legal obligations.

When an account is permanently deleted, information associated with that account will be deleted as described in Section 11.

14. SERVICE PROVIDERS

Computech may use third-party companies to provide infrastructure or services necessary to operate RaceBase, such as hosting, cloud infrastructure, email delivery, payment processing, application distribution, crash reporting, or other technical services.

These providers may process information on Computech’s behalf only to the extent reasonably necessary to provide their services.

The use of a service provider to process information on Computech’s behalf is not a sale of your personal information.

Computech does not authorize its service providers to sell RaceBase personal information obtained from Computech for their own purposes.

15. PAYMENT INFORMATION

If purchases, subscriptions, or other payments are processed through Apple, a payment processor, or another third-party platform, payment-card information may be collected and processed directly by that provider rather than Computech.

The provider’s own privacy policy and terms may govern its handling of that payment information.

Computech may receive transaction-related information such as purchase status, subscription status, transaction identifiers, product purchased, payment status, or similar records necessary to administer the purchase or subscription.

16. APPLE AND MOBILE DEVICE SERVICES

The RaceBase mobile application may be distributed through Apple’s App Store or other authorized application-distribution platforms.

Apple and other platform operators may independently collect information relating to application downloads, purchases, devices, diagnostics, or use of their services.

Information collected independently by Apple or another platform provider is governed by that provider’s privacy practices and not this Privacy Policy.

17. CHILDREN

RaceBase is a motorsports application and is not designed for the purpose of collecting personal information from children.

Because motorsports may include junior racing participants, an adult account holder may voluntarily enter racing information relating to a minor driver.

Parents and legal guardians should carefully consider what information they enter regarding a minor and should avoid entering unnecessary personal information.

Where applicable law requires parental or guardian authorization for the collection or processing of a child’s personal information, Computech will comply with those requirements.

Computech does not knowingly sell personal information belonging to children.

18. MARYLAND PRIVACY RIGHTS

Computech Systems Inc. is located in Maryland and intends to handle applicable personal information consistently with Maryland privacy law.

To the extent applicable to a particular consumer or processing activity, Maryland residents may have rights concerning their personal data, including the right to:

  • Confirm whether Computech is processing their personal data;
  • Access personal data maintained about them;
  • Request correction of inaccurate personal data;
  • Request deletion of personal data provided by or obtained about them, subject to applicable legal exceptions;
  • Obtain certain personal data in a portable format when required by law;
  • Obtain information concerning categories of third parties to which personal data has been disclosed;
  • Opt out of qualifying targeted advertising;
  • Opt out of the sale of personal data; and
  • Opt out of certain qualifying automated profiling activities.

Because Computech’s stated policy is not to sell RaceBase personal information or use RaceBase personal information for third-party targeted advertising, those activities are not part of Computech’s intended RaceBase business model.

Computech may need to verify your identity before fulfilling certain privacy requests.

Where Maryland law applies, Computech will respond to verified consumer requests within the period required by applicable law.

If Computech denies an applicable privacy-rights request, you may have the right to appeal that decision. Instructions for submitting an appeal will be provided with the decision when required by applicable law.

19. EXERCISING YOUR PRIVACY RIGHTS

When submitting a privacy request, please provide enough information for Computech to reasonably identify the applicable RaceBase account and verify that you are authorized to make the request.

Computech may request additional verification when reasonably necessary to protect an account from unauthorized access or deletion.

20. LEGAL DISCLOSURES

Computech may preserve or disclose information when Computech reasonably believes disclosure is required to:

  • Comply with applicable law;
  • Respond to a valid subpoena, warrant, court order, or other binding legal process;
  • Respond to lawful requests from government authorities;
  • Protect the rights or property of Computech;
  • Protect users or members of the public;
  • Investigate suspected fraud or unlawful activity; or
  • Protect the security and integrity of RaceBase and Computech systems.

Computech will not voluntarily provide private RaceBase information to third parties merely because the information may be commercially useful or interesting to them.

21. BUSINESS TRANSFERS

If Computech is involved in a merger, acquisition, reorganization, financing, sale of substantially all assets, or similar business transaction, information associated with RaceBase may be transferred as part of that transaction where permitted by law.

Any successor responsible for the RaceBase Services will remain subject to applicable privacy obligations concerning personal information transferred as part of the transaction.

22. THIRD-PARTY LINKS AND SERVICES

RaceBase or Computech websites may contain links to third-party websites or services.

Computech is not responsible for the privacy practices, security, content, or activities of independent third parties. Users should review the privacy policies of those third parties before providing personal information to them.

23. CHANGES TO THIS PRIVACY POLICY

Computech may update this Privacy Policy periodically to reflect changes to RaceBase, Computech’s business practices, technology, or applicable law.

When material changes are made, Computech may provide notice through RaceBase, the RaceBase mobile application, the Computech website, email, or another reasonable method.

The effective date appearing at the beginning of this Privacy Policy identifies when the current version became effective.

24. MARYLAND LAW

This Privacy Policy is intended to operate consistently with applicable United States federal law and the laws of the State of Maryland, including applicable Maryland consumer privacy and personal-information protection requirements.

Nothing in this Privacy Policy is intended to waive or restrict any privacy right that cannot lawfully be waived or restricted.

To the extent a provision of this Privacy Policy conflicts with a mandatory requirement of applicable law, the applicable legal requirement will control.

IMPORTANT ACCOUNT DELETION NOTICE

By requesting deletion of a RaceBase account, the user acknowledges that deletion is intended to be permanent. Once the account-deletion process is completed, Computech cannot restore the account or recover the user’s deleted RaceBase information. Users should preserve any information they wish to retain before deleting their account.
