Terms & Conditions

By accessing, installing, using, or otherwise interacting with the RaceAir®, RaceAir Pro®, RaceAir Cloud®, RaceBase®, WeatherPro®, DataMaxx®,  or any related software, hardware, firmware, cloud services, APIs, websites, or associated services (collectively, the “Services”), you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you may not use the Services.

The RaceAir, RaceAir Cloud, RaceBase, associated software, firmware, cloud infrastructure, hardware designs, algorithms, calculations, formulas, trademarks, logos, images, documentation, and all related intellectual property are the exclusive property of Computech Systems Inc. and are protected by United States and international copyright,

trademark, patent, and trade secret laws. No ownership rights are transferred to the user through the purchase or use of any Computech Systems, Inc. product.

All weather data, calculated values, telemetry, derived metrics, historical records, proprietary calculations, and any other information generated by, transmitted through, or made available by the RaceAir Cloud or related Computech Systems, Inc. services (collectively, “Data”) are the exclusive property of Computech Systems, Inc.

Subject to these Terms, Computech Systems, Inc. grants the authorized user a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Data solely through authorized Computech Systems, Inc. software and services for the user’s personal or internal business purposes. No ownership or other proprietary rights in the Data are transferred to the user.

Except with the express prior written permission of Computech Systems Inc., users may not:

–   Broadcast, stream, relay, retransmit, mirror, or otherwise distribute the Data.

–   Share, provide, sell, sublicense, lease, license, or otherwise make the Data available to any third party.

–   Integrate the Data into third-party software, websites, mobile applications, databases, APIs, dashboards, analytics platforms, or cloud services.

–   Use the Data to operate, support, enhance, or provide any commercial or subscription-based weather, racing, analytics, or data service.

–   Reproduce, publish, archive, cache, copy, or maintain historical repositories of the Data except as necessary for authorized use within RaceBase.

–   Redistribute live or historical Data to other users, organizations, or automated systems.

–   Commercially exploit, monetize, or otherwise profit from the Data in any manner.

–   Remove, alter, obscure, or misrepresent the source of any Data obtained from the RaceAir Cloud.

Any rights not expressly granted herein are reserved by Computech Systems, Inc. Unauthorized distribution or commercial use of the Data constitutes a material breach of these Terms and may result in immediate suspension or termination of access, revocation of licenses, and pursuit of all available legal and equitable remedies.

Users may not directly access, intercept, monitor, decode, emulate, modify, or otherwise communicate with the RaceAir Cloud device or any RaceAir weather station using serial communications, USB communications, wireless communications, network protocols, or any other method except through software expressly authorized by Computech Systems, Inc.

This includes reading raw serial communications, capturing or decoding communication protocols, creating software that interfaces directly with RaceAir hardware, circumventing authentication or communication mechanisms, or developing unauthorized drivers, interfaces, or communication libraries.

The RaceAir Cloud is intended to be accessed exclusively through Computech RaceBase software or other software expressly authorized in writing by Computech Systems, Inc.

Users may not develop, use, or distribute software or services that communicate with the RaceAir Cloud except through officially supported interfaces provided and authorized by Computech Systems, Inc.

Except as expressly authorized in writing by Computech Systems, Inc., users may not access, retrieve, collect, monitor, or otherwise obtain data from the RaceAir Cloud or any Computech Systems, Inc. service through automated or programmatic means.

Prohibited activities include, but are not limited to:

–   Using robots, bots, spiders, crawlers, scrapers, harvesters, or similar automated tools.

–   Developing or using unauthorized APIs, SDKs, libraries, plugins, middleware, or software interfaces.

–   Polling, querying, or accessing the RaceAir Cloud through automated scripts or applications.

–   Circumventing or attempting to circumvent authentication, access controls, rate limits, security measures, or usage restrictions.

–   Creating or maintaining databases or repositories containing data obtained from the RaceAir Cloud.

–   Mirroring, caching, copying, archiving, or otherwise storing RaceAir Cloud data for redistribution or commercial use.

–   Using any automated means to collect data for benchmarking, competitive analysis, machine learning, artificial intelligence model training, or the development of competing products or services.

Access to the RaceAir Cloud is provided solely through RaceBase software and any other software, APIs, or interfaces that Computech Systems Inc. expressly authorizes in writing. Any unauthorized automated access or data collection constitutes a material breach of these Terms and may result in immediate suspension or termination of access, revocation of licenses, and any other legal or equitable remedies available to Computech Systems, Inc.

No license or right is granted to access, use, or develop against any undocumented, private, internal, or reverse-engineered API, communication protocol, or service endpoint.

Users shall not reverse engineer, decompile, disassemble, analyze, reconstruct, derive source code, or discover or recreate proprietary calculations, correction algorithms, formulas, mathematical models, or data processing methods used within the RaceAir, RaceAir Cloud, RaceBase software, firmware, cloud services, or related products.

Any attempt to reproduce or approximate proprietary formulas or algorithms through observation, testing, statistical analysis, automated data collection, or any other means is expressly prohibited.

Users may not use the Computech Systems, Inc. name, trademarks, logos, product names, product images, screenshots, marketing materials, or other proprietary branding, including RaceAir, RaceAir Cloud, RaceBase, or Computech, in any commercial, promotional, advertising, endorsement, sponsorship, or other for-profit activity without prior written permission from Computech Systems, Inc.

The names Computech®, DataMaxx®, EGT Plus®, RaceAir®, RaceAir Pro®, RaceAir Remote®, RaceAir Cloud®, RaceBase®, Track Stick®, VRT®, Vehicle Reaction Timer®, Weather Pro®, and R/T Reader®, together with all associated logos, product names, trade dress, graphics, images, screenshots, documentation, and branding are proprietary intellectual property of Computech Systems, Inc.

Users may not use the Services or any information obtained through the Services for the purpose of developing, improving, marketing, or supporting any competing weather station, cloud service, racing software, or related product.

Computech Systems, Inc. reserves the right to monitor access to its cloud services and investigate suspected violations of these Terms. Violations may result in immediate suspension or termination of cloud access, revocation of software licenses, permanent account termination, legal action for damages, injunctive relief, and recovery of attorney’s fees and costs where permitted by law.

Any rights not expressly granted herein are reserved exclusively by Computech Systems, Inc. No license or permission shall be implied from the use of the Services.

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law principles. Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located within Maryland.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms constitute the entire agreement between the user and Computech Systems, Inc. regarding the use of the RaceAir, RaceAir Cloud, RaceBase, and related Services and supersede all prior agreements concerning their subject matter.
